• Weekly 30-min Zoom check-ins and direct messaging anytime.

 

Your first payment will be due upon registration and will cover your first month of the program. Subsequent payments will be automatically billed every 30 days from the date of your initial payment. It is your responsibility to ensure that payment information is kept up-to-date, and sufficient funds are available to cover the monthly fee.

 

Automatic Cancellation: To provide you with a hassle-free experience, the Fit90 program is designed with an automatic cancellation policy. After the third monthly billing cycle, your subscription to the program will automatically terminate, meaning you will not be billed further beyond the initial three-month period. Upon completion of the 90-day program, you will have achieved the full course of the Fit90 experience, and your access to the program resources will conclude. There is no need for you to take any action to cancel the program as this will happen automatically. However, if you wish to discontinue the program before the completion of the 90-day period, please refer to our separate cancellation policy.

 

Acknowledgment: By enrolling in the Fit90 program, you agree to these billing terms and understand that your commitment is for the full duration of the three-month program. This policy is part of our commitment to transparency and providing you with a clear and straightforward path to achieving your fitness goals.

 

FIT90 WEIGHT LOSS GUARANTEE

 

Guarantee Commitment: We are confident in the effectiveness of the Fit90 program and its ability to help participants achieve significant weight loss. Accordingly, we offer a guarantee to all participants: if you do not lose between 20-40lbs of body fat within the 90-day duration of the program, we will provide you with a full refund of the program fees.

 

Eligibility Criteria: Program Adherence: Participants must fully adhere to the Fit90 program, including all prescribed workouts, nutrition plans, and scheduled consultations. Regular use of the Fit90 app and participation in weekly Zoom calls is mandatory.

 

Documentation: Participants are required to document their progress, including logging activities and meals in the Fit90 app and providing regular updates during weekly calls. Initial and Final Assessments: Participants must complete the initial and final body composition assessments using our specified body mapping technology. These assessments will be used to verify the weight loss achieved.

 

Refund Process: If a participant believes they are eligible for a refund, they must submit a refund request within 7 days of completing the program. The request should include all documentation of program adherence and results. The Fit90 team will review the refund request, and if eligibility criteria are met, the refund will be processed within 30 days of the request.

Limitations: The guarantee is only applicable for participants who have completed the full 90-day program without interruption. This guarantee does not cover any weight loss that occurs outside of the specified 20-40lbs range. Acknowledgment: By signing up for the Fit90 program, participants acknowledge and agree to the terms of this weight loss guarantee. Participants understand that weight loss results can vary greatly from person to person, and achieving the guaranteed result requires commitment and adherence to the program as prescribed.

 

FIT90 LLC LIABILITY WAIVER AND RELEASE OF CLAIMS

 

Acknowledgment of Risks: I hereby acknowledge and agree that participation in the Fit90 program involves inherent risks and dangers associated with physical fitness activities, including but not limited to bodily injury, strain, fractures, partial and/or total paralysis, death, and other ailments that could cause serious disability. I recognize that these risks may be caused by my own actions or inactions, the actions or inactions of others participating in the program, or the condition in which the program takes place. Disclaimer: I affirm that I have sought medical advice regarding my participation in the Fit90 program, or I willingly choose not to seek such advice and hereby assume all responsibility for my participation in the program. I understand that Fit90 is not a medical organization and cannot provide me medical advice or diagnosis.

 

Release of Liability: To the fullest extent permitted by law, I hereby release, waive, and discharge Fit90, its officers, agents, employees, trainers, representatives, and successors from any and all liability, claims, demands, actions, and causes of action whatsoever directly or indirectly arising out of or related to any loss, damage, injury, or death, that may be sustained by me while participating in the program or while using the facilities or equipment, regardless of whether such loss is caused by the negligence of Fit90, its representatives, or otherwise.

 

Assumption of Risk: I willingly agree to assume full responsibility for any and all risks that I am exposing myself to as a result of my participation in Fit90 and accept full responsibility for any injury or death that may result from participation in any activity, class, program, personal training, or any other event organized by Fit90.

 

Compliance with Instructions: I agree to observe and obey all rules and warnings, and further agree to follow any oral instructions or directions given by Fit90, its employees, representatives, or agents. Emergency Medical Treatment: I hereby give consent for emergency medical treatment, if needed, as a result of any injury sustained from my participation in the Fit90 program.

 

Understanding & Agreement: I have read this liability waiver and release of claims, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this waiver freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
